A class-action lawsuit was filed against Apple and AT&T last week in the Plano office of the U.S. District Court for the Eastern District of Texas. And I’m part of the class.
The suit represents all Texas residents who bought an iPhone 3G or iPhone 3-GS after July 1, 2008. Apparently some are upset because they thought the newer models of the iPhone were capable of sending text messages with pictures and videos included.
I didn’t have a cell phone before I bought my iPhone in the fall of 2008, and I’m pleased to say that my communication needs have remained fairly simple. It never occurred to me that I might want to text a photo to someone.
But the plaintiffs are asking for $5 million in damages for their mental anguish. If they happen to win or settle, and I happen to receive a check for $1.73 about 10 years from now, so be it.
$1.73? You’ll be lucky to see 25 cents out of the deal. More likely result? A coupon for $10 off if you add some new service or buy a new product!
and the lawyers get a check for $250,000. Isn’t it funny how that works out?
This will adversely affect my Apple stock, and is a great example of how ridiculous class action lawsuits have become. It would have been cheaper for the company to issue all the wronged parties a new phone, but common sense has long evaporated in our world. And now we get health care reform sans tort reform — I cannot wait for the fun to begin!
I got mine in late June and they were pretty clear at the AT&T store about what my phone could NOT do just yet…but it was coming. (It did less than a month later.) I was a little annoyed that my phone that was supposed to be far superior didn’t have a capability I had on my Flinstones phone for years. But then I got over it. Priorities, people, priorities.
If I bought my iPhone a year prior based on info that was wrong or misleading, I can see AT&T needing to be reprimanded. But still, this is the ability to text an image we’re talking about. Is $1.73 going to fill the void?
Though, I do have a question. Is this $5mill just for Texans? As far as I’m aware, a few/couple/several/all states have similar/the same class action lawsuits, as well. I looked up info and found Louisiana, Illinois and Alabama, as well. $5mill a state is some MAJOR dough.
This is just more proof that people are WAAAAAY to attached to their phones.
Seriously people, you can access the internet on your phone but every day of your life still sucks because you can’t send a photo of your cat/baby/huge turd to your friends.
