I must be missing something. The last time I checked, SEC’s action was civil, NOT criminal. Else Cuban would be facing prison time.

WTF is with Mark Cuban’s brother getting involved. Kind of gettin Bizzaro World-ish.

Apparently his brother has a blog. His brother has uploaded a PDF of private emails between Cuban and the SEC:

There is some serious smack going on in some of those emails. Thinly veiled threats between the Trial Counsel for the SEC and Cuban himself. SAUCY!

I suspect that everything Cuban has said publicly was previously disclosed to the SEC in an attempt to keep them from proceeding with litigation in the first place. Also, the SEC’s case is criminal, not civil — Cuban can pay the penalty plus fine out of money he can find stuck in his couch cushions. On the other hand, he is a public figure, the owner of one professional sports franchise, and a finalist to purchase another — he has a lot of incentive to come out and attack the credibility of the SEC’s case. Unlike Roger Clemens and his ilk, I bet Cuban and his defense team can back up what they are saying.
