Daniel — you might want to check the IRS Website for what constitutes an employee and what doesn’t.

“An employee is generally subject to the business’s instructions about when, where, and how to work.”

When and where — So unless you have the right to do that (set your own hours)– you aren’t an independent contractor, you are an employee.

And I had the unfortunate experience of serving on and often chairing the License and Permit Appeal Board which deals a lot with Sexually Oriented Businesses.

I have no objection to them, but you often left wanting to take a shower.

Alacrity = cheerful willingness or earnestness. Not a great sentence, it’s true, but I meant that he seems to be cheerfully willing to reveal his ignorance (on the matter of independent contracting). America’s office buildings are stocked bow-to-stern with independent contractors, very few of whom would claim to set their own hours.

Since when is that one of the requirements to “qualify” as an independent contractor? You are ill-informed, and show great alacrity in revealing as much.

It is about the same as the fiction that strip clubs in Dallas try to perpetrate by claiming their girls are “independent contractors”. Since one of the requirements to qualify as an independent contractor is that one sets their own hours, I asked “So on a Friday night you don’t know if Bambi, Candy or Luscious is going to show up” — and with a straight face they replied “yes”
