Just in case you a) didn’t know, or b) wondered if we didn’t know, Deep Ellum is the topic du jour at City Hall, as several bars are having to defend their Special Use Permits. I could go on and on about the complex issue, or I could just link to Sam Machkovech’s plea for action or to the exhaustive research and updates that Wilonsky has worked on this morning and yesterday. Let the record show that Deep Ellum clubs went 6 for 7 with one positive-looking postponement today.
Here’s an angle worth mentioning:
“WHEREAS, while it is recognized that, in time, residential uses in the area may increase, those who choose to live in this district should expect that noise, odor, and the visual intrusions associated with those business uses will be greater than those normally associated with other residential areas. It is the expressed intent of this ordinance to preserve and protect the business uses which currently exist or have traditionally existed in this area and to this end, the provisions of this ordinance should be broadly interpreted;
WHEREAS, the city council finds that it is in the public interest to establish this planned development district, to be known as the Deep Ellum/Near East Side District.”
It appears that nearby property owners must assert a compelling encroachment argument OVER AND ABOVE normal noise, etc., generated by the typical bar/restaurant.
Also, great care must be taken so that competitors and others not be allowed to use STRAWMEN to eliminate business activity.
Maybe our elected representatives, and those on the board, should be reminded of the preamble of the adopted ordinance – PD 269.
The Deep Ellum business owners came to the city asking for the Ordinance. I was Chair of the CPC at the time. The residents of Deep Ellum did not come down to the hearing and offer any comments. When people move into a Mixed Used District it means just that
mixed use and noise is a part of the uses.
People who chose to move into entertainment
Districts should not complain about music until 2AM most clubs are open until then.
Yep, the appointed officials obviously looked over that part. What a sham! My Monkey Bar is closed, bring on the Starbucks.
