A former federal prosecutor says it goes like this (and I’m paraphrasing): IF the allegations are true, Albanese could be on the hook for mail and wire fraud (the latter requiring the communication to cross state lines, the former not so much). Not only did her alleged scheme defraud those who submitted entries, but it defrauded the Press Club (duh). The board itself is probably going to be fine. At least as far as the courts are concerned (excepting the court of public opinion). To bring criminal charges, they would have had to have participated in the alleged scheme — or they would have had to exhibit what’s called “deliberate ignorance.” Think ostrich. Think head in sand. Now, that’s for criminal liability. Civil liability is another matter. But it’s hard to imagine who would sue the Press Club board in civil court.
